LPTV Broadcasters
LPTV broadcasters traditionally were broadcasters operating under 3 kilowatts (VHF) and 150 kilowatts (UHF) who held secondary spectrum priority to full power broadcasters. However, since 2009, digital conversion has changed the thinking and regulation of these broadcasters. Digital LPTV stations now operate under an effective radiated power of 300 watts (VHF) and 15 kilowatts (UHF). So long as the tower structure has been registered with the FCC, there are presently no limits on transmitter output power and on antenna height for these providers. There is also no limit on the number of LPTV stations that may be owned by any one entity. Current broadcast licensees, cable operators and newspapers may own LPTV stations. The FCC no longer accepts applications for new analog LPTV stations, and, digital LPTV and TV translator station applications are now only accepted within certain window periods.
Generally, LPTV comprises locally focused television programming broadcasters that service rural communities or niche communities within larger urban areas or regions. Unlike full-power broadcasters, LPTV stations have the option of requesting either an on-channel digital conversion “flash cut” or permission to construct a “digital companion channel” to operate with their analog channel. Digital companion channels also have a secondary spectrum priority to full power television stations. In regard to conflicts with cable providers, the FCC maintains a “first in time, first in right” policy. Under this policy, the cable system or LPTV station that had initial use of the channel has first priority and is not responsible for correcting the interference.

Entities holding attributable interests in those licensees have also been required to file their own, separate, ownership reports. All such entities must obtain an FRN to complete the filing process. Our firm also acquires the FRN IDs for any entities holding attributable interest.
