Civil Litigation, Arbitration and Appeals
The Maldonado Law Group has three primary areas of representation in federal
or state litigation: telecommunications & technology claims; general
civil litigation; and general business law. The MLG takes an active approach
to all stages of litigation, including, pre-suit investigation and development,
pre-suit defense planning, pre-trial and trial work, and appeals in both
state and federal courts. Since civil litigation can involve a broad spectrum
of claims, depending on the subject matter being litigated, the Litigation
Practice Group maintains on-going relationships with expert witnesses
in the areas of: certified forensic accounting, handwriting, electrical
engineering (VoIP, telecommunications, and Satellite), systems network
administrators and technicians, regulatory compliance, business valuations,
and private investigations. The Litigation Practice Group also maintains
relationships with other attorneys in various jurisdictions throughout
the United States allowing MLG to represent clients in multiple jurisdictions
through Pro Hoc Vice appearance. The Group’s federal practice in
telecommunications & technology is often called-into active cases
to support or coordinate aspects of pre-trial and trial work in tandem
with local attorneys needing support in our niche areas of practice.
Our primary jurisdictions for litigation are the state and federal courts
of the State of Florida, however, the practice group has participated
Pro Hoc Vice in cases in New York, New Jersey, Colorado, Illinois, Texas
and California. Some examples of the types of cases regularly handled
by the firm are as follows:
Telecommunications & Technology: Carrier billing disputes, failed
joint ventures and mergers, patent infringement defense, distribution
channel disputes, hacking of VoIP traffic, breach of service contracts,
defense of consumer claims, breach of warranty of manufacturer of telecom
equipment, contracts and breach of contract by unlicensed common carriers,
and breach of re-marketer claims of stored value products.
General Business Law: Accounting actions, copyright and trademark infringement,
business torts, breach of contract, creditor collection claims against
businesses, employment claims, shareholder derivative claims, shareholder
direct actions, disputes regarding licensed businesses or professionals,
construction claims, real estate claims of developers, business misrepresentation,
civil fraud or theft in business, civil RICO defense, and appeal of administrative
actions against professional licenses.
General Civil Litigation: Civil forfeiture, property rights, constitutional
claims with administrative agencies and wrongful death of employees against
private employers.
The Litigation Practice Group also is active in representing clients involved
in Arbitration before the American Arbitration Association (“AAA”)
and in Court Ordered Mediation. In many instances, such forums are a cost-effective,
and private, alternative to the courts. While this alternative dispute
resolution forum allows room for negotiation and settlement, the vigor
in which the client’s case, position, or damages must be presented
does not change. The Litigation Practice Group is keenly aware of this
and has successfully brought cases to final hearing on their merits.
In addition to keeping our clients informed on the progress of their on-going
cases, the MLG Litigation Practice Group also provides the additional
service of updating our clients on changes in the law as they may apply
to their businesses or professions to avoid future problems or conflicts.
